New technique gives precise picture of how regulatory RNA controls gene activity

ScienceDaily (Sep. 29, 2011) ? A new technique developed by researchers at the Stanford University School of Medicine allows researchers to identify the exact DNA sequences and locations bound by regulatory RNAs. This information is necessary to understand how the recently identified RNA molecules control the expression of neighboring and distant genes.

The study offers a startling glimpse into the intricate world of gene expression and how RNA, once thought to be only a lowly cellular messenger, actively unlocks our DNA-based genome. "We used to have to just infer where these RNAs were acting based on their biological effects," said Howard Chang, MD, PhD, professor of dermatology. "But now we can identify precisely where on the chromatin they are binding. We've found that these sites are focal, numerous and sequence-specific."

Deciphering the role of regulatory RNAs is critically important to understand many cellular functions, including those involved in development, cancer and regeneration.

Chang, who is also a member of the Stanford Cancer Institute, is the senior author of the work, which will be published Sept. 29 in Molecular Cell. He and his lab previously identified some of the first known regulatory RNAs, including one in 2007 they called HOTAIR. Graduate student Ci Chu is the first author of the research.

Fifty years ago, researchers first identified messenger RNAs, which serve to transcribe the genetic instructions encoded in the DNA from the nucleus and deliver it to the cell's protein-building machinery. Over time, the unidirectional flow of information from DNA to RNA to protein became known as biology's "central dogma." Regulatory RNAs challenge that notion by binding to DNA and affecting which genes are selected to become proteins.

The existence of these regulatory RNAs, also called long intergenic non-coding RNAs, or lincRNAs, was first postulated decades ago by researchers who realized that DNA packaged into chromatin (a coiled complex of DNA and proteins) contains more than twice as much RNA by weight as DNA. They wondered if the RNA coating the chromatin actively regulates when and how specific genes are turned on and off. But technical difficulties have made it difficult to identify precise sites of binding until now.

"To capture this picture, you have to trap that interaction between lincRNAs and chromatin in living cells," said Chang. "It was not at all obvious how to do that."

In the end, Chu devised an innovative riff on a common assay used to identify the DNA sequences bound by a class of proteins called transcription factors. For that experiment, researchers mix protein and chromatin and then use antibodies to isolate, or immunoprecipitate, both the protein of interest and its preferred binding site.

Instead of using an antibody, Chu and Chang used two or three chemically tagged, complementary nucleotide sequences, or probes, to isolate the regulatory RNAs after they had bound to the DNA. However, they could capture only about 10 percent of the regulatory RNA using this method. Eventually Chu hit on the idea of using dozens of individually labeled nucleotide sequences that bind throughout the molecule.

"The problem was that RNA is a long, floppy molecule," said Chang. "During the experiment, it would get broken into pieces and the chemical tags would be lost. So, since we didn't know exactly which portion of the lincRNA binds to the chromatin, we made a series of tagged probes to bind to every part of the lincRNA." This "tiling" approach ensures that, even if the RNA molecule is fragmented during the procedure, the researchers will still be able to isolate the small portion that remains bound to chromatin.

Using the new technique, Chu and Chang were able to investigate the binding specificity of three lincRNAs -- one from the fruit fly, and two from mammalian systems. They found that one, called roX2, seems to coat genes on the single X chromosome in males and facilitate gene expression.

"We showed that roX2 very precisely binds to the X chromosome only in male cells," said Chang, "and it does this in a gradient, binding more and more at the transcriptional end of the gene. This appears to help elongation and make transcription more efficient, which is important because male animals have only one copy of the X chromosome as compared to a female's two."

Another lincRNA from humans, a component of the telomerase complex called TERC, occupies not just a chromosome's telomeres (protective caps at the end of chromosomes), but also genes involved in the Wnt pathway, which has been shown to control self-renewal.

"This shows an interesting and direct connection between the machinery for chromosomal replication and self-renewal," said Chang. "It's possible this helps the cell monitor the status of its telomeres."

Finally, HOTAIR, first identified in Chang's lab, seems to recruit a gene-silencing protein complex called polycomb to bind broad swaths of DNA.

"Taken together, our research shows that our technique is widely applicable and can vastly enrich our understanding of how regulatory RNAs unlock the genome in many very specific ways," said Chang. "It's very exciting."

In addition to Chu and Chang, other Stanford researchers involved in the study include bioinformatician Kun Qu, PhD; graduate student Franklin Zhong; and associate professor of medicine Steven Artandi, MD, PhD.

The research was funded by the California Institute for Regenerative Medicine, the National Institutes of Health, the Howard Hughes Medical Institute, and the Agency of Science, Technology and Research of Singapore.

MILWAUKEE - Prince Fielder remembers the last time he hit three home runs in a game. It was in high school, during an intrasquad scrimmage.

For all his baseball-bashing exploits, Fielder had never homered three times in a game in the majors ? until Tuesday.

After massive home runs in the third and fifth inning, Fielder hit a two-run shot in the seventh that lifted the Milwaukee Brewers to a 6-4 victory over the Pittsburgh Pirates.

"You guys know me," Fielder said. "If I see it, I'm swinging hard."

Milwaukee star Ryan Braun went 1 for 2 with a pair of walks, and remains locked in a tight race with the New York Mets' Jose Reyes for the NL batting title going into the final game of the season.

Reyes went 3 for 6 in a loss to Cincinnati and is batting .336 for the year. Braun is at .335.

Rickie Weeks also homered for Milwaukee, his first since returning from an ankle injury ? and as much as Fielder celebrated his own home runs Tuesday, he actually seemed more excited after Weeks' drive.

"There's going to be more of those, I'm sure, from him," Fielder said.

John Axford pitched a 1-2-3 ninth for his 46th save.

Fielder's decisive final homer actually was the least impressive of the three, barely sailing over the wall in right field after he hit monster shots earlier in the game. But it was the last one that made the biggest difference, breaking a 4-4 tie.

With the win, the Brewers crept closer to securing home-field advantage in the first round of the playoffs. Milwaukee came into Tuesday's game with a one-game advantage over Arizona for the No. 2 seed in the NL.

After the game, the televisions in the Brewers clubhouse were tuned to the Diamondbacks' game against the Los Angeles Dodgers.

"They're fired up for it," Brewers manager Ron Roenicke said. "They're fired up to finish this season off right to get into the playoffs and whether it's just home-field advantage, I don't know. But there's a very good attitude in how we're going about these games."

Fielder is happy the Brewers have something left to play for to keep them sharp, even after they clinched the NL Central.

"That's very important," Fielder said. "Not that we can't do it on the road by any means, but everybody knows we play a lot better at home. It's good to have the fans behind you, get your confidence, a little swag before you have to go on the road."

But even if Wednesday's finale doesn't have a bearing on playoff seeding, Fielder didn't plan on sitting out. He wants to play all 162 games.

"I just like playing," Fielder said. "I don't like sitting on the bench at all."

LaTroy Hawkins (3-1) took the win, and Jared Hughes (0-1) was charged with the loss.

Fielder's big night was the third three-homer performance for the Brewers this season and left him with 38 on the year. Corey Hart and Casey McGehee had three-homer games earlier in the season.

Fielder and Weeks hit back-to-back homers in the third. Weeks, who sprained his left ankle July 27 and returned Sept. 8, now has 20 homers this season.

Pittsburgh's Ross Ohlendorf scattered five hits in five innings ? but three of those hits went a very long way, thanks to Fielder and Weeks.

Brewers starter Randy Wolf struggled, throwing 111 pitches in 5 2-3 innings. He gave up nine hits and four runs, including a bases-loaded walk that turned out to be his final batter.

"I was a little bit off today," Wolf said. "And every time they scored, we seemed to find a way ? or Prince really found a way ? to step up and have big hits."

After beating the Brewers on Monday, Pittsburgh got off to a fast start. Neil Walker led off the second with a ground-rule double, then scored when a looping line drive by Matt Pagnozzi fell in front of right fielder Hart.

With two outs in the third, Fielder drove a 1-0 pitch from Ohlendorf to the second deck in right field, tying it at 1. Weeks then hammered a ball to left, appearing to rattle the window panes of a restaurant in the third deck.

The Pirates used some deception to take the lead in the fifth. After a ground-rule double by Ronny Cedeno, Ohlendorf came to the plate and faked a bunt to draw the defense in ? then swung away and made solid contact, sending a single through the largely vacant middle of the infield. Cedeno scored on the play to tie at 2.

Ohlendorf later scored on a single by Josh Harrison that glanced off the glove of diving shortstop Yuniesky Betancourt, giving the Pirates the lead.

But the Brewers came right back in the bottom half of the fifth. Braun walked with two outs, and Fielder hit a huge home run to center.

The Pirates loaded the bases with two outs in the sixth, and Wolf walked in a run.

But Fielder wasn't finished. After Braun walked in the seventh, Fielder hit his third ? then came out of the dugout for a curtain call.

NOTES: Making a start in center field, Jerry Hairston Jr. showed his range by running down several fly balls. Roenicke rested Nyjer Morgan after he fouled a pair of balls off his leg Monday, but Morgan appeared as a pinch hitter in the eighth. ... Cancer is typically diagnosed in four stages, with the first being early and latter representing advanced disease. For this reason, cancers caught in earlier stages can be easier to treat. An example is skin cancer. For localized melanoma, the five-year survival rate is 98 percent; it drops to 62 percent and 16 percent for later regional- and distant-stage diseases, respectively.

GE is hoping to use its investment to bring promising cancer ideas to market to improve diagnostic accuracy even further. The Church and the Homosexual | One Utah

There?s an old joke ? in the Bible there are 300 verses about straight people and 6 about gay people; it?s not that God doesn?t love gay people, it?s that heterosexuals need more supervision.? I?m borrowing the title of John J. McNeill?s landmark book for this post.

FWIW, this post turned out much more challenging than I expected when I began.?

When I started writing, I had to basic ideas ? first to explore some of what lies behind the often unhinged resistance of so many Christians to glbt rights and issues and second what if anything is the relationship between glbt persons and the Christian church.? It?s impossible to write about the relationship between the church and gay people without acknowledging? that the Christian church, historically and in the present day, has been and is pointlessly, repeatedly and sadistically cruel toward glbt persons.? It has denied their full humanity and it has more often than not been the agent of their oppression, repression and destruction.? To deny this reality is to be willfully blind to the damage the church is fully capable of inflicting upon people in the name of orthodoxy and right morality.?

The church?s cruelty, though not consistent in all times, places, denominations, intensities?or behaviors, has been an ever present reality for gay people for centuries.? To be gay in the Christian world has been to be automatically suspect; at a minimum, sexual minority persons have suffered from a malign neglect.? Sexual minorities have adopted various strategies for survival, the most common of which is the creation of a relatively closed subculture; in the 60s, prior to Stonewall, elaborate cultural and social taboos against homosexuality led to the formation of a subculture dominated by fear, anonymity, furtive sexual contacts and the mob, which usually owned and ran the bars.? To be gay in pre-Stonewall America was to be a regular target of official harassment by law enforcement.? The church, rather than standing on the side of those abused by the power structure, gave that power structure their full and explicit support.? When the church spoke about gay people ? which it didn?t do very often ? it did so in toxic ways.

And yet, despite this reality, glbt persons have refused to leave the church ? almost any church choir worth its salt has got more than a few gay people singing, directing or playing music.? Medieval monasteries and abbeys were home to more than?a few devout queer people, many of whom no doubt had lifelong intimate relationships with one another (with or without active sexuality since the enforcement of the rules was far from uniform).? Today, despite conservative Christians organizing national campaigns against glbt rights, the gay community has refused to turn its back on the church.

GLBT issues divide the church precisely because they occur at the intersection of personal life, Biblical authority, and the social order.? How one reads the Bible is perhaps the central question in Christianity today.? Is the bible an inerrant authority or is it the product of a set of social and historical circumstances which must be understood contextually?? Do we read St. Paul as a final arbiter of church order or do we understand him as a product of his culture, limited by it, but still valuable?? Do we read the Revelation of St. John as a metaphorical and allegorical product of religious vision or is it a literal map to the ?end times??? For a great many American fundamentalists, the latter interpretation shapes their worldview; it?s impossible to hear fundamentalist preachers talk about Israel without realizing they perceive it not as a nation-state but as part of a divine plan for Armageddon and the Second Coming.? If the Bible is an inerrant source of authority, then its rules and regulations must be obeyed without question lest one risk one?s eternal soul going to damnation.? (And yes, I know that even supposed Biblical literalists do not actually take the Bible literally and treat large parts of it as if they no longer apply ? i.e. almost all of the Jewish purity laws are dismissed as not applying to Christians.)

The faithful who so readily ignore huge chunks of Mosaic law insist on applying the Levictical injunction against men laying with me as with women literally ? of course to gay men.? All those other rules don?t count.? It?s as if a great many fundagelical Christians have picked the one sin they are pretty sure they won?t ever commit and decided it is the big one.? It sometimes seems that if conservative Christians took half the energy they spend condemning glbt people and focused it on homelessness, poverty, and other forms charity, they could transform the world tomorrow.

But that ignores one of George Lakoff?s most profound insights from Moral Politics ? conservative objections to gay rights are grounded in the conservative conception of social order as a strict father family.? The strict father family structure envisions a social order in which the authority figure stands atop an obedient hierarchy of men over women, adults over children, and spirit over body.? It is a social order which values self control and which sees giving into temptation as conclusive evidence one lacks control; it sees homosexuality not as a state of being but as nothing more than a physical act.? Gay people have gay sex because they lack the self control to not have it.? A same sex couples also fails to recreate the preferred social order ? by definition a household of two men or two women lacks a primary male authority figure ? a strict father ? who hands out rules and punishment and who is accountable for the household?s obedience.? The film Far From Heaven accurately portrays the meltdown of a strict father household ? as the father fails in his role, the family flies apart (fwiw, Far From Heaven is one of the smarter films I?ve seen in terms of its social commentary and its ability to portray racism, sexism and heterosexism and it is one of the most visually stunning films I?ve seen in years).?

GLBT persons and rights strike at the core of what it means to live in a moral, conservative household.? By arguing and understanding homosexuality as a matter of choice, conservative Christians in essence sidestep the moral, legal and social issues.? If something is a choice, than you can unchoose it and the problem goes away.? By envisioning being gay as an addiction, as nothing more than a behavior, fundamentalists offer a solution to the moral problem ? just stop being addicted and you will start obeying the rules.? When conservative Christians describe being gay as a choice, they are doing so because their moral system has no other means of dealing with it; in a paradoxical way, that position is a kind, even compassionate one.? By almost any standard, there is no way for someone embracing fundamentalist moral theology to make homosexuality morally acceptable; by arguing it is changeable, the fundamentalist Christian offers gay people a means of becoming moral and going to Heaven.

To my mind, the primary failure of this position lies in not questioning or examining the validity of the rule itself.? What is it that makes being gay immoral?? It?s forbidden by the Bible; but for what reason is it forbidden?? Is it actually forbidden?? Did the Biblical authors actually understand sexual orientation as we do today?? All of these questions strike at the core of Biblical authority, raising the very real question that the Bible is fallible and flawed.? If Biblical authority crumbles then entire moral system itself crumbles.?

Both the Catholic and Mormon churches take the official position that being gay isn?t a sin, but acting on your gay feelings is.?

Author John J. McNeill rightly points out that any god who creates gay people and then tells them they must spend their lives ? willingly or not ? celibate is a cruel and sadistic god.? If being gay is not a sin then how is it a sin to fall in love, to have intimate relationships, to have sex??

Perhaps recognizing that they have no good answer to that question, conservative Christians have developed a second line of reasoning ? that sexuality serves the purpose of procreation and nonprocreative sex is immoral and damaging and must therefore be regulated.? John J. McNeill addresses this argument by pointing out that this view of sexuality reduces both our partners and the act of sex to nothing more than object, nothing more than a means to an end.? Arguing that sexuality is primarily for reproduction is starkly reductionist.? But, it also places same sex couples forever outside the moral circle since their sexuality cannot make babies.? Contrary to this view (advocated by many liberal Christians) is the view of sexuality as a means unto itself, a source of joy, union, communion and knowing of persons.? McNeill defines sexuality as a form of play ? something that occurs when one feels safe and free to express one?s self fully, something which serves no end beyond itself.

Conservative Christians have recently expanded their arguments against glbt rights to include claims that expanding civil rights protections and enacting marriage equality constitute an infringement on religious freedom.? These arguments place opposition to glbt rights at the center point of Christian doctrine; IOW, you can?t be Christian unless you are anti-gay.? Suffice to say that?s hardly a traditional or orthodox position of Christianity.

All of which would suggest that glbt folk would be better off walking away from the Christian church.? Even the more liberal and tolerant denominations have generally failed to effectively advocate for the rights of glbt persons.? Justin Lee, director of the Gay Christian Network, observed:

As I turned to my church and the Christians I respected most to get their support, things only got worse. Christian groups kicked me out or turned their backs on me when they learned that I was gay, even though I told them that I didn?t want to be and that I hadn?t even acted on my feelings! I learned that that one magic word, ?gay,? had the power to make Christians turn unkind and uncompassionate without even realizing they were doing it.

?By almost any measure, the Christian church is a hostile environment for glbt persons.? Which brings me to a difficult question: What place exists within Christianity for openly gay, lesbian, bisexual and transgender persons?? Lee reported the same interview that some members of the GCN have chosen to remain celibate in view of scripture.? Such a position baffles me ? I tend to hold the view that celibacy can be valuable at times in almost any life but it is not good to force it on people who are not truly called to it.? I don?t believe for even a moment that anything in the Bible requires us to give up intimate relationships on the basis of a thousands of years old injunction given by a?dubious and probably mythical deity.

Should glbt persons even want a place within the Christian church?? Can the church be redeemed of its centuries of malignant hatred??

You may not have heard of Ken Globus, but the bespectacled gent who became known as the Bird Whisperer tamed thousands of antisocial avians over the past 25+ years. Ken learned how to deal with birds at his parents? pet store in Inglewood, California, where almost all of the birds were caught in the wild. By literally throwing out the books on bird-raising and using his own innate sensitivity, he eventually established a new way of taming even the most un-handleable birds.

Inducted into the Women Divers Hall of Fame in March of 2011, Cristina Zenato has been a tireless advocate for the welfare of sharks and is the Diving Supervisor, Dive Instructor and Shark Dive professional at UNEXSO (UNderwater EXplorers SOciety) on Grand Bahama Island. Cristina has learned the delicate procedure of tonic immobility from her mentor, Ben Rose, and has used the technique to remove hooks from the mouths of oft-voracious Caribbean Reef sharks.

Not to be outdone in the shark whispering department (and in other news, there?s a shark whispering department) is Mike Rutzen, a South African diver who?s been dubbed ?Sharkman? by his less-daring fellow divers. Rutzen performs tonic immobility on sharks by balancing them face-down on his palm and massaging their snouts. How he gets them into that position in the first place is another story entirely.

The Wolf Whisperer

Maybe if Li?l Red had applied Shaun Ellis? wolf whispering methodology and talked to the ears, not the hand, maybe Grandma would still be alive & kicking and the wolf wouldn?t seem quite so big and bad. Ellis, also known as The Wolfman, takes ?hands-on? interaction to the highest level possible without actually becoming a member of a wolfpack? oh wait, he?s done that too.

Quite a different way to interact with wolves is conducted at the International Wolf Center in Ely, Minnesota, where captive wolf packs have been maintained since 1989. Wolves at the IWC are socialized to humans at a very early age and
any physical human interaction is limited to a selected group of Wolf Care staff, enabling easier veterinary checks and excellent wolf behavior viewing opportunities from the center?s glass windows.

Daniel ?Horse-Whisperer? Sullivan kept his methods secret but onlookers reported he would stand face to face with his equine subjects and would appear to be whispering to them.

What Sullivan and later followers were practicing was Natural Horsemanship, a gentle way of training horses dating back at least to the era of Classical Greece. Practitioners of natural horsemanship avoid techniques involving punishment that inculcate fear in the horse being trained. Instead, subtle body language and a system of behavioral negative reinforcement are applied, with the goal being to forge a willing partnership with the horse.

Hawaii Five-0: Could the Team Lose Kono? (omg!)

The Hawaii Five-0 task force had a reunion of sorts in last week's season premiere, but the team won't be the same now that there's a new boss, Lt. Gov. Denning (Richard T. Jones), in charge.

"He's a little tougher than the old one, so we need to be more careful with him," Scott Caan, who plays Danny "Danno" Williams, tells TVGuide.com. On Monday's episode (10/9c, CBS) Denning demonstrates that he's not about to let Five-0 slide with their lawless methods. He assigns Homeland Security profiler Lori Weston (Lauren German) to join the team to keep them in check.

Apple trims 25 percent of iPad orders, or maybe just moves them to new Brazil plant, report says (Appolicious)

Market analysis of Apple?s moves with the iPad suggest that the company has cut its orders for the fourth quarter of 2011 by 25 percent ? but it might not be as big a deal as all that.

The research report comes from JP Morgan analysts Mark Moskowitz and Gokul Hariharan, according to an article from Boy Genius Report. The analysts expect Hon Hai, Apple?s iPad 2 assembler, to decrease production from 17 million units to 13 million units. However, Moskowitz hasn?t adjusted his shipment projections for Apple, which remains at 10.9 million iPad 2s for the third quarter of 2011 and 12 million for the fourth quarter.

It seems like a strange time to be cutting iPad 2 production, as BGR points out. Here?s a quote:

Speculation surrounding the reported production cuts vary greatly, and some theories are more likely than others ? if JP Morgan?s report, which it says it has confirmed with multiple sources, is even accurate. Some suggest sales of Apple?s iPad 2 may be slowing or production could be cut ahead of the iPad 3 launch.

There have been some rumors about the possibility of an iPad 3 this year, going back as far as the launch of the iPad 2 in March and earlier, but it seems unlikely at this point that Apple would undercut its device by releasing another iteration this year, after so many people lined up for the iPad 2 and orders were backed up for months. Now that customers have their devices, it?s somewhat doubtful Apple would spring a new one on them.

As BGR writes, what seems like a much, much more likely scenario is that Apple is moving production to the new iPad plant that manufacturer Foxconn opened in Jundia?, Brazil, last week. That plant probably won?t begin shipping tablets until the latter part of the last quarter of 2011, but it would make sense that Apple is reducing its orders from other factories in order to spread them around more. What?s more, it?d be an easy factor for analysts to miss when talking with their sources, who might not know about the change.

Regardless, it probably doesn?t mean a new iPad is on the way, as some have speculated. It just doesn?t seem like a new iPad six months out from the launch of the last iPad would make any sense.

Edra J. Pollin: Medical Marijuana Lights Up Child Custody Court

Amid the flurry of accusations in child custody disputes, allegations of marijuana use rank high on the list. Until recent years, the court's position on this subject was easy to predict since judges and child custody evaluators maintained a zero tolerance policy toward smoking pot. In child custody cases within the greater Denver area, attorneys routinely admonished our clients that even if you're smoking only when the kids are with the other parent, enjoying a Rocky Mountain high is illegal, ill-advised and potentially devastating to your parenting time request. In court, when one parent cried marijuana, the other parent was ordered to a drug testing facility for a hair follicle test or random urinalysis. If the offending parent flunked the drug test, the next visit with their ten year old just might be under the supervision of a local agency.

Flash forward to 2011. The soup du jour is medical marijuana, and MM dispensaries have been sprouting up like weeds throughout the Denver/Boulder area and the entire country. Since implementation of Amendment 20, which amended the Colorado Constitution to recognize medical marijuana, the MM business has flourished. According to a recent report from The Daily, Denver now has more MM dispensaries than Starbucks and at least 125,000 Colorado residents have a license to smoke MM. If smoking irritates the lungs, one can always opt for medicated pizza or cheesecake at the edible outlet. In a state which is otherwise known for its healthy, fit and youthful population, a surprising number of people now require regular medication for the treatment of sore joints, chronic pain or additional physical ailments.

While Colorado is particularly fertile ground for growers and users of MM, all indications are that the legalization of medical marijuana is becoming a national phenomenon. A recent report from ProCon.org states that sixteen states plus Washington DC now have laws legalizing medical marijuana. According to the See Change Strategy report of March of 2011, the medical marijuana industry nationwide is a $1.7 billion dollar market with 24.8 million potential customers. In Phoenix, Arizona, where voters approved medical marijuana last fall, a local big box store which does not sell marijuana but which specializes in hydroponic equipment for marijuana growers is commonly referred to as the "Walmart of Weed."

The explosion in medical marijuana has caused a corresponding relaxation in the national attitude about use of this drug with or without an MM license. All of this poses new questions and challenges for the courts in cases where one parent's allegation of substance abuse is solely related to marijuana. If a parent is a card-carrying marijuana patient, does this give the parent a carte blanche license to take their medication before or during their court ordered parenting time? Since the doctor's prescription for this medicine has no specific dosage, can the court rationally determine that a particular patient is over-medicating? When one parent's use of marijuana is undisputed, is that conduct sufficient to order supervised parenting time or must the accusing parent also establish that unsupervised parenting time would endanger the children's physical health or emotional development?

The latter question was answered by the Colorado Court of Appeals in the 2010 case of Marriage of Parr, 240 P.3d 509 (Colo.App.Div.1 2010). At the time of their divorce, the parties' parenting plan required the father to take ongoing UA's to show that he did not return to marijuana use. Shortly after the divorce, dad got his MM license. Dad filed a motion to waive the drug testing and, when it was denied, mom filed a motion to restrict dad's parenting time. One year later, after dad had been exercising unsupervised parenting time for the past eighteen months, the trial court ordered dad back to supervised parenting time with mandatory hair follicle testing. The Colorado Court of Appeals reversed this portion of the trial court's order upon a finding that the trial court could not require supervised parenting time for dad based solely on his marijuana use without a specific finding that dad's conduct endangered the child physically or impaired the child's emotional development as set forth in C.R.S. ?14-10-129(1)(b)(I). Since Colorado follows the Uniform Dissolution of Marriage Act, it is likely that the Parr case will be cited as legal precedent in other states which have legalized medical marijuana. (Note that the Parr decision does not address the parties' property settlement but the rumor is that mom was awarded the house and dad got the potato chips.)

In the wake of the Parr decision, attorneys and litigants in child custody disputes have some measure of guidance when addressing one parent's accusation regarding the other parent's marijuana use. If you're the parent who is seeking supervised parenting time for your pot smoking partner, whether or not they have an MM license, be prepared to present credible and specific evidence that the other parent's conduct endangers the child's physical health or emotional development. If you're the smoking parent, your first and arguably best approach in a child custody dispute is to do a cost/benefit analysis of the situation and "Just say no" to future marijuana use. When that's not a viable option, be ready to show a strong pattern of competent, child-focused parenting along with evidence that your consumption of marijuana has never endangered your child. That said, if your testimony lacks conviction and you're sinking fast under a blistering cross examination, you may have to switch gears at the end and employ the defense of a former president, "I didn't inhale".
